These Terms govern use of aibelai.com and purchases from AIBELAI. By using the website or placing an order, you agree to these Terms and to the policies and license applicable to the product. Nothing in these Terms limits rights that cannot legally be excluded.

1. Store and eligibility

You must provide accurate information and have legal capacity to enter into a contract. You may not use the website or products for unlawful, fraudulent or abusive purposes.

2. Products and availability

AIBELAI sells digital image collections and may offer Custom Creations. Product pages describe the files, format, price, license and delivery method applicable at the time of purchase. Images shown on the website may be previews. We may correct genuine errors or withdraw a product before an order is accepted.

3. Prices, payment and taxes

Prices are displayed in the currency shown on the website or at checkout. The final checkout amount may include applicable taxes. Payment is processed through Shopify and the payment methods shown at checkout. An order is accepted when payment is confirmed and an order confirmation is issued, subject to fraud and availability checks permitted by law.

4. Digital delivery

No physical item is shipped for a digital product. Delivery is made by the download or access method described on the product page, order confirmation or delivery email. The customer is responsible for providing a valid email address and for downloading and securely storing the files.

5. Commercial license

Each digital product is supplied under the AIBELAI Standard Commercial License unless another license is clearly stated. A purchase grants usage rights only and does not transfer ownership of the source files, the AIBELAI brand or any AIBELAI digital character.

6. Digital characters and AI-created content

AIBELAI digital characters, including Naomi Bellini, are fictional AI-created characters. They are not real people and do not provide or imply a real-person endorsement. Standard purchases are non-exclusive. AI-created content and the laws governing it may evolve; the customer is responsible for ensuring that a planned use is lawful and appropriate in the relevant territory and industry.

7. Custom Creations

Submitting an enquiry does not create a paid engagement or guarantee acceptance. If a project is suitable, scope, deliverables, timing, price, permitted use and any exclusivity will be agreed separately before paid work begins. The customer must have the right to provide all briefs and reference materials and remains responsible for factual claims, trademarks and other materials supplied for the project.

8. Refunds

Refunds and cancellations are governed by our Refund Policy. For digital content, withdrawal rights may end when access or downloading begins after any express consent and acknowledgement required by applicable law. Defective, incomplete or inaccessible files remain covered by mandatory consumer rights.

9. Intellectual property and website use

The website, previews, text, visual identity, files and digital characters are protected to the extent permitted by applicable law. You may not scrape, copy, reproduce or exploit website content or bypass security or access controls except as expressly permitted by a product license or by law.

10. Third-party services

The store uses Shopify and may use third-party payment, delivery, analytics and communication services. Their services can be governed by their own terms and privacy notices. AIBELAI is not responsible for interruptions outside its reasonable control, but this does not affect mandatory rights.

11. Liability

To the maximum extent permitted by law, AIBELAI is not liable for indirect or consequential loss, loss of profit or loss caused by unauthorised or prohibited use of the files. Any liability that cannot legally be excluded remains unaffected.

12. Governing law

These Terms are governed by the laws applicable in Spain, without depriving consumers of mandatory protections available in their country of residence. Courts and dispute procedures will be determined by applicable law.

13. Changes

The version in force at the time of purchase governs that purchase. We may update these Terms for future use of the website and future orders.
